What Personal Information Do We Collect and Process?

We collect and disclose personal information as described below. We do not sell personal information for money. Some disclosures to advertising and marketing partners may, however, be considered a “sale,” “sharing,” or processing for targeted advertising under applicable privacy laws. You can opt out as described under “Do Not Sell or Share My Personal Information.” We seek to limit the personal information we collect, use and retain to what is reasonably necessary and proportionate for the purposes described in this Statement.

Personal information you provide. We collect personal information that you provide through the Services, at events, and in communications with our Customer Service Department. We may combine information collected through these channels and use and disclose it in accordance with this Statement.

You may browse portions of the Website without directly submitting personal information; however, certain features and transactions require it. “Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household. Depending on how you interact with us, we may collect contact details; account credentials and preferences; billing, shipping and transaction information; products viewed, added to a cart or wishlist, purchased, returned or reviewed; customer-service communications; content you submit; promotion or survey responses; and approximate location inferred from your IP address.

We collect your email address and ZIP Code if you subscribe to our newsletter, and your mobile number if you opt in to text messages. When you make a payment, payment-card and financial-account information is collected and processed by Shopify or other payment providers. We receive transaction and payment-confirmation information and may receive limited payment details, such as card type and last four digits, but we do not store complete payment-card numbers.

In certain areas of the Website, you may be asked to provide personal information in connection with registration, customer-service requests, reviews, warranties or other features. A contest or sweepstakes will be accompanied by rules that describe any materially different use or disclosure of entry information.

Personal Information Collected Automatically

We and our service providers may automatically collect personal information and other usage information when you interact with the Website (“Usage Information”). This may include IP address, device and browser information, operating system, unique identifiers, referring URLs, pages viewed, links clicked, searches, cart activity, access times, interactions with our communications, and information about how you navigate or interact with the Website. How Do We Use Cookies, Similar Technologies, Advertising and Online Tracking?

If your browser sends a recognized universal opt-out signal, such as Global Privacy Control (“GPC”), we treat the signal as a request to opt out for that browser and device and, where we can associate the signal with your account, for that account. How Do We Use Your Information?

We use information for business and service-related purposes, including to provide, operate, maintain, secure and improve the Services and our products. For example, we may use personal information to process payments and orders; arrange shipping, returns, exchanges and warranties; maintain accounts; provide customer service; administer promotions; send transactional communications; send marketing communications; and personalize the Website, our communications and your shopping experience.

We may contact you about sales, new products and services, Website features, and special or personalized offers, subject to your communication preferences. We may combine offline purchase history with information collected online to maintain accurate records, understand our customers, improve the Services, provide recommendations and market our products.

We use Usage Information to understand Website use, improve and secure the Services, prevent fraud, measure advertising and personalize the Website and our communications. We may combine Usage Information with other information, including personal information, for these purposes. How Do We Disclose Your Information?

We may disclose personal information: (1) to Shopify and vendors that provide payment processing, order fulfillment, shipping, customer support, IT, hosting, security, fraud prevention, data analytics, market research, email and text-message management, reviews, promotions and other services on our behalf; (2) to advertising, analytics, social-media and marketing partners for advertising and measurement, including disclosures that may be considered a “sale” or “sharing” under applicable law; (3) to our affiliates and within our corporate group; (4) to parties you direct us to or when you otherwise consent; (5) to law enforcement, government authorities, courts, litigants, professional advisers or other parties as required or permitted by law, to comply with legal process, enforce our terms, protect rights, property or safety, investigate fraud or security incidents, or establish, exercise or defend legal claims; and (6) in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets or similar business transaction. Service providers and contractors are permitted to process personal information only for specified purposes and subject to contractual restrictions required by applicable law.

Relationship with Shopify

The Website is hosted by Shopify, which collects and processes personal information about access to and use of the Website to provide and improve the Services. Information submitted through the Website is transmitted to Shopify and relevant service providers, which may process it in countries other than your own. We also may use Shopify features that use information about your interactions with our store, other merchants and Shopify to protect, personalize, grow and improve our business. For certain Shopify-controlled processing, Shopify is responsible for responding to privacy requests. What Steps Are Taken to Help Secure Personal Information?

We maintain reasonable administrative, technical and physical safeguards designed to protect personal information. However, no security measure or transmission over the Internet is completely secure, and we cannot guarantee absolute security. The Website uses transport encryption to protect information in transit. Please do not send sensitive or confidential information through unsecured channels.

If you create an account, you are responsible for maintaining the confidentiality of your credentials. If you wish to cancel your account or become aware of loss, theft or unauthorized use of your credentials, contact us promptly using the information under “How to Contact Us.”

How Long Do We Retain Personal Information?

We retain each category of personal information only for as long as reasonably necessary for the purposes described in this Statement, including to provide the Services; maintain accounts; complete transactions; provide customer service, returns and warranties; maintain business and tax records; comply with legal obligations; prevent fraud; resolve disputes; and enforce agreements. Retention periods vary based on the nature and sensitivity of the information, the purposes for which it is processed, applicable limitation periods and legal requirements. We delete or deidentify information when it is no longer reasonably necessary for those purposes, unless longer retention is required or permitted by law.

Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Purchases and account creation are intended for adults. If you believe a child under 13 has provided personal information to us, contact us so that we can take appropriate action. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

Links to Third-Party Websites

This Statement does not apply to websites, applications or services operated by third parties. We are not responsible for their content, security or privacy practices. Review the privacy notice of each third-party service you use.

Information you submit in public or semi-public areas, such as reviews, feedback sections or social-media pages, may be visible to others. Use care when posting personal information publicly.

How Do I Opt Out of Receiving Promotions?

You may opt out of promotional emails by using the “unsubscribe” link in the message. You may opt out of promotional text messages by replying “STOP.” Standard message and data rates may apply. Even if you opt out of marketing, we may continue to send non-promotional communications about your account, orders, transactions or our ongoing business relationship.

How Does This Statement Apply to International Users?

The Services are intended for users in the United States. If you access the Services from outside the United States, your personal information may be transferred to, stored in and processed in the United States and other countries whose laws may differ from those where you live. Where required, we use legally recognized transfer mechanisms and other appropriate safeguards.

We do not discriminate or retaliate against you for exercising privacy rights. If we deny a request, we will explain the basis as required by law. ADDITIONAL PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This section supplements the rest of this Statement for California residents and uses terms defined by the California Consumer Privacy Act, as amended (“CCPA”). The disclosures below describe our practices during the preceding 12 months. “Sold/shared” refers to disclosures that may constitute a sale or sharing for cross-context behavioral advertising under the CCPA; it does not mean that we sell personal information for money.

For each category below, we identify representative examples, sources, purposes, recipients, sale or sharing practices, and retention criteria.

Identifiers

We collect identifiers such as name, alias, postal address, email address, phone number, online identifiers, IP address and account identifiers. We collect these directly from you, automatically from devices, and from service providers and partners.

We use identifiers to provide the Services, fulfill orders, communicate with you, maintain security, perform analytics and support advertising. We disclose them for business purposes to service providers, Shopify, fulfillment and payment partners, and analytics providers.

We may share identifiers with advertising networks, social networks, data analytics providers and marketing partners for cross-context behavioral advertising. We do not sell identifiers for money.

We retain identifiers for as long as reasonably necessary for the purposes described above, including applicable legal, tax, accounting, fraud-prevention, dispute-resolution and enforcement needs.

Customer Records Information

We collect contact, payment and transaction-related information described in California Civil Code section 1798.80(e), directly from you and from payment and commerce providers.

We use this information to process transactions, fulfill orders, provide customer service and comply with law. We disclose it for business purposes to payment processors, Shopify, fulfillment providers and professional advisers.

We generally retain transaction records for the period required by tax, accounting, warranty, fraud-prevention and other legal obligations.

Protected Classifications

We may collect age or gender if you voluntarily provide it in a promotion, survey or other interaction. We collect this information directly from you.

We use this information to administer the relevant interaction and comply with law. We may disclose it to service providers supporting that interaction.

We retain it only as long as reasonably necessary for the interaction and applicable legal obligations.

Commercial Information

We collect information about products viewed, purchased, returned or considered, shopping-cart and wishlist activity, and purchase history. We collect it directly from you, automatically through the Services, and from Shopify and commerce partners.

We use commercial information for transactions, service improvement, analytics, personalization and advertising. We disclose it for business purposes to Shopify and fulfillment, analytics, customer-support and commerce providers.

We may share commercial information with advertising networks, social networks, data analytics providers and marketing partners for cross-context behavioral advertising.

We retain it for as long as reasonably necessary for customer service, warranties, analytics, fraud prevention and legal obligations.

Internet or Other Electronic Network Activity

We collect browsing, search and interaction information, including data collected through cookies, pixels and similar technologies. We collect it automatically through the Services and from analytics and advertising partners.

We use this information to operate and secure the Services, perform analytics, personalize experiences and support targeted advertising. We disclose it for business purposes to Shopify and hosting, security, analytics and customer-experience providers.

We may share this information with advertising networks, social networks, data analytics providers and marketing partners for cross-context behavioral advertising.

We retain it according to the lifespan of the relevant cookie or similar technology, or as otherwise reasonably necessary for the stated purpose.

Geolocation Data

We collect approximate location inferred from an IP address, automatically from your device or network. We do not collect precise geolocation through the Website unless separately disclosed and permitted by law.

We use approximate geolocation for localization, security, analytics and advertising. We disclose it for business purposes to Shopify and security and analytics providers.

We may share approximate geolocation with advertising and analytics partners for cross-context behavioral advertising.

We retain it for as long as reasonably necessary for security, analytics and advertising purposes.

Audio, Electronic or Visual Information

We may collect customer-service recordings, photos, videos, reviews or other content you submit, directly from you or from customer-service providers.

We use this information for customer service, reviews, promotions, security and legal purposes. We may disclose it for business purposes to customer-service, review-hosting and professional-service providers.

We retain it for as long as reasonably necessary to address the interaction, maintain the content, resolve disputes or satisfy legal obligations.

Professional or Employment Information

We may collect information submitted by job applicants or business contacts, directly from you and, where applicable, from references or recruiting sources.

We use this information for recruiting, business administration and legal compliance. We may disclose it for business purposes to recruiting, background-check and professional-service providers, as applicable.

We retain it in accordance with applicable recruiting, employment and record-retention requirements.

Inferences

We may derive preferences or characteristics from transactions and interactions. These inferences are derived from the categories described above and may also be received from service providers and partners.

We use inferences for personalization, analytics, marketing and advertising. We disclose them for business purposes to Shopify and analytics and personalization providers.

We may share inferences with advertising networks, social networks, data analytics providers and marketing partners for cross-context behavioral advertising.

We retain inferences for as long as reasonably necessary for personalization, analytics and advertising, subject to your opt-out choices.

Sensitive Personal Information

We collect account log-in credentials and payment-account information used with required access credentials, directly from you and from payment and commerce providers.

We use this information for account access, payment processing, security and fraud prevention. We disclose it for business purposes to Shopify, payment processors and security providers.

We do not sell or share sensitive personal information.

We retain it only as long as reasonably necessary for account, payment, security and legal purposes.

California Disclosures and Rights

We do not use or disclose sensitive personal information for purposes that require offering the right to limit under the CCPA. We do not have actual knowledge that we sell or share personal information of consumers under 16. We collect, use, disclose and retain personal information only as reasonably necessary and proportionate for the purposes described in this Statement.

During the preceding 12 months, we shared the following categories of personal information for cross-context behavioral advertising: identifiers, commercial information, Internet or other electronic network activity, approximate geolocation information, and inferences. We shared these categories with advertising networks, social-media platforms, data analytics providers, and marketing partners. We did not sell or share Customer Records information, protected classifications, audio or visual information, professional or employment information, or sensitive personal information. During the preceding 12 months, we disclosed the categories of personal information described above to service providers and contractors for the business purposes identified in this Statement.

California residents have the rights described under “Do Not Sell or Share My Personal Information,” including the rights to know/access, correct and delete personal information; receive information about collection, disclosure, sale and sharing practices; opt out of sale or sharing; limit certain uses of sensitive personal information where applicable; and receive equal service and price without discrimination. Submit requests using the methods described above. An authorized agent may submit a request as permitted by the CCPA and its regulations.

California’s “Shine the Light” law permits California residents to request certain information about disclosure of personal information to third parties for their direct-marketing purposes. You may submit one request per calendar year using the contact information below.

Changes to This Statement

We may update this Statement to reflect changes in our practices or for operational, legal or regulatory reasons. We will post the revised Statement, update the “Last updated” date and provide any additional notice required by law. We review this Statement at least annually.
